Cofepris Creates The Decalogue Against Misleading

The Advertising Advisory Council, which heads the Federal Commission for the Protection against Sanitary Risks (Cofepris) published important information that all health professionals should know. This is a decalogue of actions that will guide its work as a reference body in the consolidation of an effective legal and regulatory framework to protect the well-being of the population.

This initiative arose with the aim of preventing misleading and inconsistent advertising from continuing to try to clean up the image of brands, products and services with verifiable risks to health and violation of the right to health.

Who wrote it?

This collegiate body, made up of dependencies and entities of the Federal Public Administration (APF), the academic and scientific community, the business sector, advertising media and broadcast mediahas among its objectives to analyze and give an opinion on the use and content of the codes of advertising ethics.

Likewise, it seeks to support institutions in conducting studies on advertising, issuing an opinion on matters presented by the Ministry of Health (SSa)formulate proposals for amendments to the applicable provisions on advertising, and serve as a consultative body for the development of standards on advertising that may represent a risk to health.

According to Cofepris, the actions outlined in this decalogue seek to reverse a trend that for years undermined the public health of the populationdue to a highly permissive regulation of advertisements for tobacco products, alcohol, junk food, sweetened beverages, among others, which caused an epidemic of overweight, obesity, diabetes, and increasing rates of cardiovascular diseases, which have become the main Causes of illness and death in Mexico.

Cofepris Decalogue against misleading health advertising

  1. It establishes as an objective to heal the current relationship between the market and society.
  2. Issue an opinion to avoid the use of misleading and manipulative messages that seek to profit at the expense of the health and well-being of the Mexican population.
  3. It integrates gender perspective and human rights agendas into its decisions.
  4. It reviews and modifies the current regulatory framework, in accordance with the best international practices, to empower the population in the face of the constant innovation and sophistication that advertising finds to position products and services that are harmful to health.
  5. Consultation to generate necessary actions and policies that stop, inhibit, limit or penalize advertising that disguises the characteristics of a product or service that is harmful to health.
  6. Establishes a statement of ethical principles to differentiate direct advertising from indirect advertising.
  7. Coordinates the integration of an interdisciplinary group.
  8. It supports the development of guides that establish clear and transparent criteria on the applicable provisions regarding advertising for the different productive sectors.
  9. Promotes a health culture to denounce corporate social responsibility campaigns that violate or circumvent the law by advertising products and services that represent a verifiable risk to health
  10. Makes the agreed resolutions public.
